Terms and Conditions of Sale

Please read these Terms and Conditions carefully before placing an order. By placing an order through this website, you agree to be bound by these Terms.

In these Terms, “Silverback Academic Media”, “we”, “us” or “our” refers to Silverback Academic Media. “You” or “your” refers to the customer purchasing goods from us.


1. Orders and Contract Formation

The display of products on this website constitutes an invitation to treat only. When you place an order, you are making an offer to purchase goods in accordance with these Terms.

A binding contract is formed only when we accept your order and provide confirmation of dispatch.

We reserve the right to decline or cancel an order where:

  • payment has not been authorised or received

  • a pricing or product description error has occurred

  • goods are unavailable

If we cancel an order after payment has been made, a full refund will be provided.

You are responsible for ensuring that all information provided at checkout is accurate. You will have the opportunity to review and correct errors before submitting your order.


2. Pricing

All prices are stated in Australian Dollars and include GST unless otherwise stated.

Delivery charges will be clearly displayed at checkout.

We take reasonable care to ensure pricing accuracy. If a pricing error is identified before dispatch, we will contact you to confirm whether you wish to proceed at the correct price or receive a refund.

Prices may change prior to acceptance of your order.


3. Payment

Payment must be made at the time of placing your order.

We accept the payment methods listed on our website at checkout.

Orders will not be processed or dispatched until payment has been authorised and cleared.


4. Delivery

We deliver to Australian addresses only unless otherwise stated.

Orders are generally processed within 2 to 4 business days. Estimated delivery timeframes will be provided at checkout or in your confirmation email.

Delivery timeframes are estimates only and may vary. We are not liable for delays caused by circumstances beyond our reasonable control.

Risk in the goods passes to you upon delivery. Title to the goods passes once full payment has been received.


5. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these Terms excludes, restricts or modifies any rights you may have under the Australian Consumer Law or any other applicable law.


6. Returns and Change of Mind

If you wish to return goods due to change of mind, you must contact us within 14 days of receiving the goods.

Change of mind returns:

  • must be unused

  • must be in original condition and packaging

  • may require proof of purchase

Shipping costs for change of mind returns are not refundable unless required by law.

Sale or discounted items may not be eligible for change of mind returns, unless required under the Australian Consumer Law.


7. Faulty or Damaged Goods

If goods are faulty, damaged or not as described, please contact us as soon as reasonably possible.

Where required under the Australian Consumer Law, we will provide a repair, replacement or refund depending on whether the failure is major or minor.

We may require reasonable evidence of the fault before providing a remedy.


8. Limitation of Liability

To the extent permitted by law, our liability for breach of any non-excludable guarantee is limited to:

  • the replacement of the goods

  • the repair of the goods

  • the payment of the cost of replacing the goods

  • the payment of the cost of having the goods repaired

This limitation applies only where the goods are not ordinarily acquired for personal, domestic or household use or consumption.

Nothing in these Terms excludes liability for personal injury, death, fraud, or any liability that cannot be excluded under Australian law.


9. Privacy

We collect, use and store personal information in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy.

Personal information is collected for the purpose of processing orders, managing customer accounts, and complying with legal obligations.

You may request access to or correction of your personal information in accordance with applicable law.


10. General

We may amend these Terms at any time. The Terms in force at the time of your order will apply to that order.

These Terms are governed by the laws of Australia.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
